Steps to Take in Saving Your Driver’s License

The first thing to do, if following your arrest for DUI you have received a goldenrod-colored document entitled Official Notice of Intended Suspension of Driving Privilege and Affidavit, is not to panic. Second, it’s important to know and understand what all the possible consequences can be and what your rights are.

Keep in mind that once this form has been issued it essentially means that your driver’s license may get suspended. The notice is issued either because you refused to submit to chemical testing after being lawfully arrested while driving on a public highway or because you blew a breath test of .08 grams/210 liters or higher (.02 grams/210 liters if you are under age 21). If this document is forwarded within five (5) days to the Alabama Department of Public Safety and it is otherwise in compliance with the provisions of the Administrative Suspension Act, Code of Alabama Title 32-5A-300 et seq. then your driving privilege may be suspended for not less than ninety (90) days and as much as five (5) years. The length depends on whether you have previously been convicted of driving under the influence.

Thus, if you receive one of these documents you must take immediate action if you wish to protect your right to continue to legally drive an automobile. Immediate action is important because there is a time limit here that you need to comply with. The administrative suspension law provides that you may seek an administrative hearing of the proposed suspension provided that you make such requests in writing within ten (10) days after you received the notice of intended suspension.

The administrative suspension law also provides that you may ask the circuit court in the county where the arrest took place to issue an injunction ordering Public Safety not to suspend you until the court can conduct a hearing to determine the legitimacy of the proposed suspension. It’s useful to know that oftentimes your exercise of the right to the administrative and judicial review can result in the suspension being withdrawn or the time of suspension reduced.

Alabama DUI law also provides that if you are successful in defending the underlying DUI charge you then have the right to require the Department of Public Safety to withdraw the proposed suspension and expunge any reference to it from your driver history.
